It's illegal in NYS to not take 30 minutes after 6 hours of continuous work (your choice or not).

Opting to do so is illegal. If it were optional to violate break or minimum wage laws, they wouldn't be laws. It's that they are not optional that makes them laws.

Because I am still an "Hourly" employee, It's the only way to insure I still get a full pay check til they decide I can go on salary.
It's because you are hourly that you don't have the option to opt out.

SO By deciding to eat through my work ( Which by the way I had to do as a gas station clerk in this same state making literal minimum wage for over 2 years) I am breaking a law? Great to know!Oh And Just so everyone is Clear on this : This is not my EMPLOYER this is me, doing whats best for me and my family.

Making sure I can do all the things I need to do?
This was 100 % my decision and you guys are telling me how " Illegal " It is. For me to decide to eat through my lunch a few days a week. If it had been my employer telling me this is what is expected i would believe you.
However Nebraska State law says the "Employee's can waive Lunch breaks at will"- That's how Gas stations get a way with no breaks. -

Technically you are putting your employer at risk because they are mandated to ensure that you take a break and not let you work without one (or three.) By allowing you to do it, it's no different than them incentivizing you in any other way to violate it.
Minimum wage makes it easier to explain. Imagine if your employer "let" you work for "free" an extra few hours a day and that took you below minimum wage. Clearly that would violate minimum wage law. That you "willingly" did it doesn't matter, because minimum wage only exists so that you can't willingly go below that amount. No one ever makes less than minimum wage by force, it's always willingly. So the entire basis of the law is that both sides are forced to abide by it, not just one side.

Because it is. Because what if they decided they like employing you more than someone equal or better at the job because you were willing to "break the law" on their behalf and someone else depending on them obeying the law?
The law is there to protect everyone, if anyone is allowed to ignore it, it doesn't protect anyone.

In most states, the only way to waive it is to promote the employee to manager. Which doesn't mean more money, but means that they are forced to tell other potential employers that you were a manager. And you must have the responsibilities of a manager.

This is where you are confused. It is your employer doing this. There is no way around it. It's that they allow it, which then means it's a consideration in who they employ and who they do not. It means someone not willing to waive their breaks is at a potential disadvantage. And that's specifically why the law exists, to protect the break. If you can waive the break, the break isn't protected.

It looks like the "waive" is not needed in Nebraska. Outside of blue collar mechanical jobs, Nebraska has no break protection whatsoever.

They do have a statute for a 1/2 hour break every 8 hour shift alloted for lunch..
Nebraska Ā½ hour, off premises, for lunch in each 8-hour shift. Statute Applicable to assembly plant, workshop, or mechanical establishment, unless employee is covered by a valid collective bargaining agreement or other written agreement between an employer and employee.
