Yea but this really doesn't matter. You're using to much water(car washes) to much natural gas(restaurants) so we're going to charge you more.
The idea doesn't make sense.

Yeah, I would expect someone to bring this back up under employment law.
I expect that someone will. It's obvious that this was just an attempt not to pay him and nothing more.
