      That's illegal afaik.

      Technically, It's not breaking any law because I opted to do so, So I dont lose hours : have to take my son to school on the days we don't have a grandparent available and on those days, My lunch break is from 8-9

      Because I am still an "Hourly" employee, It's the only way to insure I still get a full pay check til they decide I can go on salary.

      It's because you are hourly that you don't have the option to opt out.

      Even though It's not my Employer? Even though this was a based decision solely on the well being of my family?

      Correct. You are very confused on how this law works.

        Because it is. Because what if they decided they like employing you more than someone equal or better at the job because you were willing to "break the law" on their behalf and someone else depending on them obeying the law?

        The law is there to protect everyone, if anyone is allowed to ignore it, it doesn't protect anyone.

          In most states, the only way to waive it is to promote the employee to manager. Which doesn't mean more money, but means that they are forced to tell other potential employers that you were a manager. And you must have the responsibilities of a manager.

            This is where you are confused. It is your employer doing this. There is no way around it. It's that they allow it, which then means it's a consideration in who they employ and who they do not. It means someone not willing to waive their breaks is at a potential disadvantage. And that's specifically why the law exists, to protect the break. If you can waive the break, the break isn't protected.

              It looks like the "waive" is not needed in Nebraska. Outside of blue collar mechanical jobs, Nebraska has no break protection whatsoever.

                  They do have a statute for a 1/2 hour break every 8 hour shift alloted for lunch..
