You are missing that it's not Ubiquiti causing the problem here. We don't know why different places are listing these products, what we do know is that according to Ubiquiti, they are early release and not eligible for resale.
Do you really think B&H would be selling product that's not officially available?
I don't know what B&H does, but if they are like Amazon and NewEgg, they likely don't even know what is being sold on their website. The real question is - do you really think that B&H's website listing a product is highly relevant to determining if UBNT really released a product? If so, why when it doesn't mean anything from any other reseller of that nature.
Most large resellers like B&H are open marketplaces selling whatever people put there.
B&H is official reseller of Ubiquiti. So is Baltic Networks, both are listed when you hit find reseller on Aircube page.

That was the point. Apple has nothing to do with it because they would be the wrong channel. It's not a Ubiquiti product yet, it's not released. That makes it, in that sense, a product of the reseller in California.

@marcinozga Exactly, you don't have access because you aren't part of the beta program! Sign up for the beta program, and you will see endless posts about how these aren't ready for production and all kinds of people having the same exact RMA issues as you.
There's obviously something wrong in the distribution channel for all of these resellers to already have this product available.

You should try reversing the question. Your statement would require a law to exist in order for it to be true. You are claiming that some companies, regardless of you not being their customer, must accept an RMA from you or provide support. In order for that to be true, a law stating that they had to do that would have to be written.
In the absence of that law existing (it does not exist) then standard contract law applies which enforces the opposite. Only the contractually obligated parties in the transaction have any requirements. The terms of that obligation would come from the NewEgg Marketplace terms of service. You should look there to see if even your reseller has any support obligations, it's possible that you've waived those.

You have a conflict in the above statement. Either you claim a law exists and that it gives you the choice, or you can't have that choice. Claiming that you have that choice is claiming that a law exists.
So you have to choose. Is there a law that lets you choose like this, or isn't there? You can't have it both ways. With the absence of a law, the manufacture is not involved here as they didn't sell you anything.

Actually, no, it is not. And I clearly linked to you the terms and conditions stating as much. Just because you got scammed does not mean that the terms and condition are invalid.
But it DOES mean that you can go after the reseller. But the issues here are between you and the reseller. UBNT is an innocent third party that isn't involved. They didn't make a product for sale, they didn't sell to you, they didn't interact with you.

In @marcinozga's defense, BH Photo and Baltic Networks are both authorized resellers and they both do have the product available. Definitely seems like a distribution error here.

I don't do business with either of them, I don't know how trustworthy either is, or if they are like Amazon and NewEgg and list third party stuff and only take it down when people complain.

In @marcinozga's defense, BH Photo and Baltic Networks are both authorized resellers and they both do have the product available. Definitely seems like a distribution error here.
Or Ubiquiti hasn't posted release notes. Do they list any other beta products under main product page?

The fact that you don't have a date code screams that they sold you a beta version of it even if it is released to sale now. You need to go through the reseller.
